The General Data
Protection Regulation (GDPR) took effect in May 2018 and replaced the Data
Protection Act 1998. It gives more rights and protection to individuals
regarding use of how personal data is used. The Parochial Church Council (PCC)
is the ‘data controller’ for St Mary’s and St Barnabas Churches and decides
what personal data should be held, whether on computer or on paper, and how it
will be kept and used. Data collected for one purpose, for example, the
Electoral Roll, cannot be used for another purpose, say fundraising, without
consent of the individual. Only the minimum data should be kept for the
particular purpose. The data must be accurate and kept up to date, be stored
for no longer than necessary and the storage is to be
safe and secure. PCC will be exempt for certain requirements as it is ‘a
religious not for profit body’ but it must ensure that any processing of the
data relates only to members or former members and there is no disclosure to a
third party without consent. Whether or not exemption applies, the PCC will: ·
Review the data held, how it is stored and
what basis we have for processing it. ·
Consider whether consent is required from
some data subjects. A Data Privacy Notice has been approved by the PCC and can
be downloaded from the adjacent link |
